Beautiful autograph letter by R. Chaim Halevy Soloveitchik to his cousin and chavrusa R. Zalman Sender Kahana Schapiro. The letter opens with R. Chaim responding to R. Zalman Sender concerning his inquiry regarding purchasing Tefillin. R. Chaim responds that there are two options, Tefillin Mehudorim for more expensive and less mehudorim for cheaper and advising that “that the choice is in your hands”.
The letter continues with a question on the Sugya of “Nogach V’Achar Kach Hifkir” in Bova Kamma 13b. After extensive research, this question from R. Chaim, is previously unknown.
R. Chaim signs “Chaim B’Hagaon R’ Yosef Duber Halevy neiro ya’ir Soloveitchik, Monday, the 9th of Sivan 5641 (1881) …Volozhin”. I.e. the first year of R. Chaim Brisker’s tenure in Volozhin.
Letters from this period and unpublished novella with the signature that includes the Beis HaLevy are extremely rare!
Following Rav Chaim’s letter, R. Zalman Sender records his answer to R. Chaim’s question and signs his name.
R. Chaim Halevy Soloveitchik, known as R. Chaim Brisker (1853- 1918), was a great Talmudic scholar and innovator of the popular ‘Brisker’ approach to Talmud study; a method of highly exacting and analytical study that focuses on precise definitions and categorizations of Jewish law, with a particular emphasis on the Rambam. Following ten years as a Rosh Yeshiva in the renowned Volozhiner Yeshiva, he succeeded his father as Rav of Brisk. His primary work, Chidushei Rabbeinu Chaim Halevy, a volume of insights on the Rambam, was published posthumously by his sons and is a fundamental text studied in all Yeshivos. Additionally, R. Chaim, whose matzeiva describes him as Rav Ha’Chesed (master of charitable generosity), was also intensely involved in charitable endeavors, literally giving away all he had in order to assist the needy.
R. Zalman Sender Kahana-Schapiro (1851-1923) was a close student of the Beis HaLevy and studied together with his cousin, R. Chaim Brisker when they were both studying in Slutzk. He was one of the leading Rabbonim in Lithuania, serving as Rav in Aletsch and Krinik. His son was the famed D’var Avrohom of Kovno.

מכתב יפהפה בכתב יד מאת ר’ חיים הלוי סולובייצ’יק אל בן דודו והחברותא שלו ר’ זלמן סנדר כהנא שפירא. ר’ חיים פותח את המכתב במענה לר’ זלמן סנדר בדבר שאלתו לגבי קניית תפילין. ר’ חיים עונה שישנן שתי אפשרויות: תפילין מהודרות ויקרות או תפילין מהודרות פחות וזולות. הוא מציין ש”הברירה בידך”.
המכתב ממשיך עם קושיא בסוגיית “נגח ואחר כך הפקיר” בבבא קמא יג ע”ב. לאחר מחקר ממושך נראה שקושיא זו מר’ חיים לא נודעה עד עתה.
ר’ חיים חותם “חיים בהגאון ר’ יוסף דובער הלוי נרו יאיר סולובייצ’יק, יום ב’ ט’ סיון ה’תרמ”א (1881) …וולוז’ין”. כלומר השנה הראשונה לכהונתו של ר’ חיים מבריסק בוולוז’ין.
מכתבים מתקופה זו וחידושי תורה בלתי מודפסים עם חתימה הכוללת את ה”בית הלוי” הינם נדירים ביותר!
לאחר מכתבו של ר’ חיים, כותב ר’ זלמן סנדר את תשובתו לשאלתו של ר’ חיים וחותם את שמו.
ר’ חיים הלוי סולובייצ’יק, שנודע בכינויו “ר’ חיים בריסקר” (תרי”ג-תרע”ח 1853-1918), היה תלמיד חכם מופלג ומייסד דרך הלימוד “הבריסקאית” הפופולרית. מדובר בשיטת לימוד קפדנית ואנליטית מאוד המתמקדת בהגדרות וסיווגים מדויקים בהלכה עם דגש מיוחד על הרמב”ם. לאחר עשר שנות כהונה כר”מ בישיבת וולוז’ין המעטירה, הוא מילא את מקום אביו כרב העיר בריסק. ספרו העיקרי, “חידושי רבינו חיים הלוי”, ספר חידושים על הרמב”ם, יצא לאור לאחר פטירתו על ידי בניו והוא ספר יסוד הנלמד בכל הישיבות. בנוסף, ר’ חיים, המתואר במצבתו כ”רב החסד”, היה מעורב מאוד במעשי חסד ונתן את כל אשר לו כדי לעזור לנזקקים.
ר’ זלמן סנדר כהנא שפירא (תרי”א-תרפ”ג 1851-1923) היה תלמיד מקורב ל”בית הלוי” ולמד יחד עם בן דודו, ר’ חיים בריסקר, בעת לימודם בישיבה בסלוצק. הוא היה מגדולי הרבנים בליטא ושימש כרב באלטסק וקריניק. בנו היה ה”דבר אברהם” הנודע מקובנא.
